Order Approval: A signed proforma invoice and logo authorization form are required to proceed with an order.

Terms: Available for established accounts with approved credit. First time customers, custom or large orders will require a deposit. We accept Visa, MasterCard, American Express or company check. For payments made by company check, the order will ship ten business days after receipt of payment.

Production Time: Delk requires written approval of digital proofs prior to production. Production time varies with each product.  Please confirm with your sales representative on all production schedules.  In-stock production is 5-10 days.  Ocean freight is 60-75 days and Air freight is 30-45 days. A custom order cannot be cancelled once production has begun.

Acceptance: The customer should inspect the goods immediately upon arrival. Any loss or damage must be reported within three days of receipt. Should the customer fail to give written notice within this time, then the goods will be deemed acceptable.

Samples: Random and blank samples will be charged at list price + shipping. Overrun samples must be included on the purchase order at the order quantity price. Pre-production samples will be $40 each + shipping for non-custom orders.  Custom pre-production samples vary in price.  Contact sales rep for further information.

Virtual Mock- Ups: Tools and non-custom items are $10 each.  All custom items- Spirit Snapz, Stress Toys, Souvenir Watch, Flash Drives, etc will be $20 for the first logo and $5 for each additional logo. Virtual Mock-Up fees will be applied towards the confirmed PO total.

Indemnification: Customer warrants that it has the right to use the marks, symbols, or designs depicted in the artwork and shall indemnify, defend and hold Delk, its officers, shareholders, employees, and agents harmless from and against any claims, damages, and costs, including attorney fees, in any infringement actions resulting from use of the artwork supplied by the customer.

Catalog Designs, Artwork, and Trademarks: Artwork and trademarks shown on the products in our website and catalog are shown only as examples of the type and quality of products available. They are not intended to represent that the products are either endorsed by, or produced for the owners of the artwork or trademark.

Graphics: Price includes a one color, one position imprint- unless specifically stated. Digital vector artwork is preferred. This includes Corel Draw, Adobe Illustrator, eps, or PDF files. Digitally produced artwork sent on disc or transferred electronically that does not require retouching is also considered camera ready. Faxes, photocopies, and ink-jet printouts are not considered camera ready artwork. Additional art charges and/or turnaround time will be based on the complexity of the art. Always keep a copy of art and files. Do not send the only copy. Art media will not be returned unless requested. Set-up charge is $50.00 (v) for tools and non-custom products.  For all custom items, please contact your sales representative for exact mold and set-up fees. There is no set-up charge for exact repeat orders.

Product Specifications: Color is matched as closely as possible. An exact match is not guaranteed. Due to variances of materials, we cannot guarantee continuity of shade, color, size, texture, or construction of finished goods from lot to lot. Due to manufacturing tolerances, all dimensions have an acceptable variation of ½?. Catalog photography may not be representative of true product colors. Prices, specifications, and product availability are subject to change without notice. Our acceptance of customer?s purchase order constitutes an agreement based solely upon our terms and conditions regardless of the terms and conditions specified on the customer?s purchase order.

Shipping Information: All orders are shipped FOB our warehouse in Nashville, TN. Customer shall provide its shipping account # or 3rd party account # for shipping charges. Shipments will not be insured to cover cost of goods (unless we are otherwise instructed) against loss or damage during shipment from our warehouse to the original destination. Delk assumes no liability for loss or damage incurred during subsequent shipments made from the original destination. Delk is not responsible for carrier or en-route delays. Tracking numbers will be e-mailed to the contact person on the purchase order.

Shipments to destinations outside the United States will be made via customer's account # or customer-provided 3rd party account# for all freight, duties, taxes and fees.
